At Left Click – which has a registered corporate name of UpWave Digital Solutions LLC – and its affiliates (collectively, “Left Click,” “we,” or “us”), your privacy and that of all of our clients, users, and visitors, is important to us. This Privacy Policy discloses how we collect personal information, the types of personal information we receive and collect, our use of information, as well as the steps that we take to protect that information. The use of this Site, or any other website controlled and operated by us, constitutes your acceptance of the terms of the following Privacy Policy, including any amendments and/or revisions by Left Click, which may be made at any time. In compliance with industry standards and applicable state and federal regulations, we take the actions as described by this Privacy Policy.

 

Information Collection and Use

This Privacy Policy applies to users of our website located at www.Left-Click.com or any website owned by the owner of Left Click or any of its affiliates on which this policy is posted (collectively, our “Site”), as well as those who interact and/or communicate with us through email or otherwise. Please note that this policy applies only to sites maintained by the owner of Left Click and not to websites maintained by other companies or organizations to which we link or that link to us. We may share the personal information that you supply to us with other third-party businesses to bring selected opportunities and information to you via direct mail, email and telemarketing. These third-party businesses may include providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation, and email marketing. You can browse the Left Click website at any time without revealing any personal information about yourself. There are, however, several areas on our Site where we collect personal information from you on a voluntary basis. Legal Protection

We reserve the right to disclose your PII, as required, to comply with the law, applicable regulations, governmental and quasi-governmental requests, judicial proceedings, court orders, or legal process, and will establish or exercise our legal rights and defend against legal claims at our discretion. We will share, without notice to you, all information we possess in response to court orders, subpoenas and to comply with government investigations. At our discretion we will share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Left Click’s Terms of Use or as otherwise required by law.

 

How We Use and Share Your Personally Identifiable Information

We will share your information with the following:

  • Our companies.  Access to personal data within Left Click and our group of companies is restricted to those individuals who have a need to access the information for our business purposes.
  • Our clients.  We may share personal data with our clients or their customers as part of the offering of our services. Our clients or their customers may use the data to contact individuals at their email address, through other electronic mail, or through other means. Please note that Left Click clients will likely have their own privacy policies and opt-out options, and we recommend you review them.

    LEFT CLICK RESERVES THE RIGHT TO, AND WILL, SELL, SHARE, OR OTHERWISE TRANSFER YOUR PERSONAL INFORMATION TO THIRD PARTIES FOR ANY PURPOSE IN ITS SOLE DISCRETION. This includes sharing PII with Left Click clients, partners, sponsors, advertisers, service providers and marketers, lookup and reference services, and any other entities that Left Click believes are able to provide you with information and opportunities that might interest you. Left Click prohibits the sale or transfer of PII to non-affiliated entities for their use without first giving you the opportunity to opt-out. Although Left Click advises everyone who receives PII from Left Click to support this Privacy Policy, Left Click has no control over such party’s information handling practices and is not responsible for any failure of such party to adhere to this Privacy Policy.

  • Suppliers, subcontractors, service providers.  We keep your information confidential, but may disclose it to suppliers or subcontractors insofar as it is reasonably necessary for the purposes set out in this privacy policy. However, this is on the basis that they have agreed to safeguard this information.  This includes external third-party service providers, such as accountants, auditors, experts, lawyers and other outside professional advisors; IT systems, support and hosting service providers; technical engineers; data storage and cloud providers and similar third-party vendors and outsourced service providers that assist us in carrying out business activities.
  • Potential acquirers or investors.  As with any other business, it is possible that in the future Left Click could merge with or be acquired by another company. If such an acquisition occurs, the successor company will receive and have access to the information maintained by Left Click, including customer account information. Any successor company will continue to be bound by this Privacy Policy. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email, account message and/or a prominent notice on our website of any change in ownership or uses of this information, as well as any choices you may have regarding this information. 

 

Additionally, Left Click may share PII in aggregate, non-personal form, with select companies that wish to reach a particular target audience (e.g., female voters between the ages of 34-48, who have an average household income of over $50,000.00). This information will allow these entities to provide individual recipients with information they will find relevant.

 

Finally, Left Click may disclose PII in order to:

  • comply with applicable laws
  • respond to governmental inquiries
  • comply with valid legal process
  • protect the rights or property of Left Click, the Site, or other users of this Site

 

By registering and using this Site and/or replying to any of our communications, you acknowledge and agree that the processing of your PII for the purposes described above may involve the transfer of such PII from within the United States of America (“USA”) to countries outside the USA whose data protection regulation may not be as stringent as that within the USA.

 

Minors

You must be at least 18 years old to use this Site. We do not knowingly collect, use, or disclose personal information about visitors under 18 years of age. Cookies and IP Addresses

To serve you more efficiently and effectively, we use “cookies” technology. A cookie is a piece of data stored on the user’s hard drive that contains information about the user. Cookies are not way linked to PII. Once the user closes their browser, a cookie typically terminates. Cookies enable a website to “personalize” itself for each user and reduce the time it takes for pages to load on your computer. In order to optimize your experience, cookies also help with the collection of customer tracking data. We may also capture customer tracking data on some of our partner’s websites, related to activity involved with the completion of offers listed on our Site. Clear Gifs

We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs) that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movement of Web users. Clear gifs are not tied to users’ personal information. We also use clear gifs in our HTML-based emails to let us know which emails the recipients have opened. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. Opting-Out

We offer you choices when we ask for personal information, whenever reasonably possible. Although Left Click only supports permission-based emails, Left Click does not obligate itself to restrict third parties advertising beyond that which is required by applicable law.

 

Third Party Links

However, when you visit websites to which Left Click provides a link, keep in mind you will be interacting with a third party that operates under its own privacy and security policies, and terms of use. If you choose to obtain certain services through a third party site, the data collected by the third party is governed by that third party’s privacy policy. A third party site will also have its own policy regarding the use of cookies and clear gifs. We encourage you to review the privacy policies and terms of use of any other service provider from whom you request services.

 

If Left Click receives personal information from a third party unrelated to any service offered on our site, the use and disclosure of such information is governed by the agreement (if any) between Left Click and such third party.

 

Framing

In some cases, we may require the use third party vendors, outside companies, to operate portions of the Left Click Site and/or to provide certain services including clerical, information processing, and other services. Information submitted through these outside third parties are subject to this Privacy Policy unless otherwise stated.

We will treat your data with the utmost care and take all appropriate steps to protect it. We secure access to our websites and apps using ‘https’ technology. This complimentary report may be requested twice in a twelve-month period and will be provided within forty-five (45) calendar days from the request submission date upon verification. Failure to comply with all necessary steps will result in an incomplete request and your information report will not be sent.
